
Rudolph Giuliani has sued Smartmatic to recuperate legal expenses as he defends against its $2.7 billion lawsuits charging him, Fox News Network, and others with falsely alleging that Smartmatic assisted in rigging the 2020 U.S. presidential election so that Joe Biden will defeat Donald Trump.
Giuliani says Smartmatic’s lawsuit interfered with his constitutional right to speak freely on issues of public concern.
Smartmatic claimed that Fox News decimated its business with a bogus narrative that its election software helped Biden, a Democrat, steal the election.
Fox News and two other defendants have filed similar counterclaims citing New York’s “anti-SLAPP” law.
They and Giuliani, as well as Smartmatic, are appealing parts of a decision by state Supreme Court Justice David Cohen allowing most of the lawsuit to proceed.
